Campaign for Sustainable Safety, not Strict Liability.

For this post we've two authors. The first part is written by David Hembrow, the second part by Mark Wagenbuur.

Strict Liability
Some people outside of the Netherlands have a huge interest in "Strict Liability".

To many cycling campaigners, this looks like a "solution" to a problem which they experience on a daily basis. They want more respect and this appears to be a way to achieve it.

What the law does, in very rough terms, is to give drivers of motor vehicles the financial responsibility in the event of a crash with a more vulnerable road user. In itself, this is a good idea. It results in cyclists who are hurt in crashes being compensated by the driver of the heavier, faster, vehicle which brings the danger. However, the importance of this law is often wildly overstated across the English speaking world.

"Strict Liability" is known in the Netherlands as "art. 185 WVW" of the Dutch law. Simplified explanations of the law can be found here and here. There is no short snappy phrase for it in Dutch because this is no more than an obscure part of the law which most people take little interest in. People don't talk about this on a regular basis, any more than they do about other obscure parts of the law. Most people are not aware that the law here is different from elsewhere.

Strict Liability has, at best, a very small role to play in keeping cyclists in the Netherlands safe.

Does this mother think it's safe for her children to cycle here because "strict liability" offers financial compensation should a car hurt her children, or could it have something to do with the existence of that cycle-path ? This is what is meant by subjective safety.
How has "Strict Liability" been mis-understood ?
Changing legal liability doesn't in itself change how the streets feel. The lack of cycling in other countries is not due merely to worries about a lack of compensation for remaining family after a family member has been crushed by a truck. Rather, people are scared to cycle due to worry about being crushed by a truck in the first place. This change of law does not in itself encourage a higher rate of cycling. That was never its purpose.

In addition, how the law works is somewhat different to what many people outside the Netherlands have been told. Drivers are not held 100% liable for all crashes with cyclists. That would be quite unreasonable as there are many reasons why drivers might not be wholly responsible.

The law draws a distinction at the age of 14 years. In a collision with a cyclist or pedestrian aged under 14, a motorist is likely to be held to be responsible. However, a cyclist or pedestrian who is older than 14 years of age is expected to know how to behave on the streets and is likely to be held at least partly responsible in the event of a crash. If they're behaving recklessly then they can instantly expect at least 50% of the blame for any collision. An adult pedestrian dressed in black and crossing a road without looking can expect to be held to be liable for damage to a motor vehicle which hits him. That is what the law makes clear.

It's also important to realise that this law is only concerned with material damage and financial responsibilty. For example, if children are hit by a car in the Netherlands, the drivers insurance can never try to claim for compensation from the family of the victim. It could also help to determine who pays for repair or replacement of an adult's bicycle which has been run over by a truck. However, this law is not concerned with allocating blame, or with imprisoning bad drivers.

When did this law come into force ?
Article 185 came onto the statute here after there was a majority cycling culture. The law as it stands now dates from the 1990s when cycling in the Netherlands already looked like this. It is not at all realistic to expect to be able to introduce such a law to protect cyclists, especially to a higher degree than they are protected in the Netherlands, in countries where cyclists are a minority.

Introducing such a law to protect children is another matter, but note that in the Netherlands this law came into force twenty years after the environment started to change to protect children.

Does it have an effect on the behaviour of Dutch drivers ?
I've read comments from enthusiasts of this law along the lines of how its introduction in their country would remove the excuse of "I didn't see him" as a "get out of jail free card" for motorists. However, this is a misunderstanding of what the law is for.

Like most countries in the world, the Netherlands has a rule by which a driver whose car collides with the rear of a car in front is normally held to be responsible for the collision. The threat of being held liable has not eliminated rear end crashes either in the Netherlands or any other country. Such crashes are rarely intentional. It is a human failing that results in crashes like this occurring. The "strict liability" law in the Netherlands is very similar. It also has not had an appreciable effect on the rate of crashes between drivers and cyclists as these also are not intentional. All it has done is to make clear where financial responsibility lies after damage has been caused.

It is very rare that a more severe punishment results in less crime. If it did, then we might expect that the USA having capital punishment for murder in most states might have eliminated murders in the USA. However, the USA has an intentional homicide rate of 4.8 per 100000 people in comparison with a rate of just 0.87 per 100000 in the Netherlands, where there is no capital punishment. There is no direct relationship between punishment and behaviour. Other factors are involved.

We need to understand that few drivers set out with the intention of crashing into a cyclist. Rather, the environment that they find themselves in makes this more likely in some places than others.

Often drivers don't "see" cyclists because cyclists are in places on the road where the driver doesn't expect them to be, where the driver is not looking, where they are difficult to see, or where they can be easily missed due to other distractions. For instance, sometimes it is necessary to look in many directions simultaneously in order to cross a junction safely. That's not just an overseas problem, but is also specifically a problem at the most dangerous junction in the Netherlands.

So what really does keep Dutch cyclists safe ?
If we can engineer roads in a way that takes human failings into account and which results in crashes, injuries and deaths being less common then this is a far more reliable way to improve safety than any amount of punishment after the event.

The really important principle in road design from the Netherlands which is worth campaigning for is Sustainable Safety. This emerged in the 1990s at almost exactly the same time as "Strict Liability" but has received nowhere near as much attention outside of the Netherlands. These days it is the principle of design by which Dutch roads and streets are made to be easy to use, self-explanatory and safe by default, preventing crashes from occurring.

Sustainable safety isn't only for cyclists, but also for other road users including drivers. It's a good part of the reason why Dutch roads are very safe for all road users. Not only is the experience of cycling in the Netherlands different from elsewhere. For a driver, Dutch roads are different to roads in Germany, Belgium, France or the UK. They're a pleasure to drive on. Very easy to use, and as a result, very safe.

For example, at traffic lights here, whether for cyclists, pedestrians or for drivers, if you have a green light then you can go. You don't get cars coming in the opposite direction also with a green light, or turning across you.

This is a different concept of road safety to that in use elsewhere in the world

Sustainable Safety and Campaigning
While it's virtually impossible to get support for "Strict Liability" in most countries because it is seen as a measure to promote the rights of a minority above those of a majority, Sustainable Safety is good for everyone. It not only increases safety for cyclists, but also for every other road user. Because of this, campaigning for sustainable safety to become a principle of road design in other countries has a good chance of mass support.

Not only is Sustainable Safety far more achievable than "Strict Liability", but with its proven record of improving the safety of the Dutch it's also much more likely to have a positive effect on the safety of cyclists, pedestrians and drivers in other countries than is a misinterpretation of a minor Dutch law.

One of the fundamental reasons why Sustainable Safety improves the safety of every road user is that it keeps interactions between different road users, and particularly different types of road users, to the absolute minimum. Without interactions you have fewer chances for mistakes to be made and fewer chances of collision. Sustainable Safety
Sometimes campaigners and traffic engineers in other countries have trouble understanding Dutch traffic reports. These reports are not always very clear whether they are about separated cycling infrastructure or not. An example: some months ago there were misunderstandings about Fietsbalans (“Cycling balance”) reports that do indeed not clearly state where separated cycle paths were meant. This even led to the mistaken understanding with some ‘anti-infrastructuralists’ that cycle paths were “irrelevant”. But to the Dutch their system is so obvious that it isn’t necessary to specifically mention those separated cycle paths. So what are the principles of the Dutch underlying system?

Sustainable Safety is the name of the Dutch approach to achieve a better road safety (“Duurzaam veilig” in Dutch). The main objectives of this vision are preventing severe crashes and (almost) eliminating severe injuries when crashes do occur. It was introduced and quickly adopted by all road managers in 1992 and has since been very successful. In 2005 it was revised and extended. The approach began with establishing that the road system was inherently unsafe. The goal was to fundamentally change the system by taking a person as a yardstick. The physical vulnerability of a person, but also what a person can and wants to do (humans make mistakes and don’t always follow rules) were to be guidelines for design. There is now an integral approach to the road system which refers to ‘human’ (behaviour), ‘vehicle’ (including bicycles!) and ‘road’ (design). Roads and vehicles must be adapted to the human capabilities and the human has to be educated enough to be able to operate a vehicle on a road in a safe manner. The approach is pro-active, it wants to remedy gaps and mistakes in the traffic system before crashes occur. So Sustainable Safety is about a lot more than just infrastructure.

Sustainable Safety is based on five principles:
  1. Functionality (of roads)
  2. Homogeneity (of mass, speed and direction of road users)
  3. Predictability (of road course and road user behaviour by a recognisable road design)
  4. Forgivingness (of both the road and street environment and the road users)
  5. State awareness (by the road user)
The principles are based on scientific research and theories from traffic engineering, biomechanics, and psychology. Since the 2005 revision the principles are also based on infrastructure, vehicles, intelligent transport systems, education and enforcement of laws and regulations.

1. Functionality of roads
To the Dutch the most ideal situation is when roads and streets have only one single purpose. To achieve this mono-functionality a hierarchy of roads was introduced.
  • Through Roads for high volumes of fast traffic on longer distances.
  • Local Access Roads from which end destinations can be reached.
  • Distributer Roads which connect through roads and local access roads.
All Dutch streets and roads have been classified (under a legal obligation) and are or will be re-designed to the Sustainable Safety principles by the road managers. This led to areas where people stay (residential areas and areas for shopping/sporting/theatre etc.) and designated space used for the flow of traffic in order to transport people from A to B. Under the Dutch vision these functions cannot be mixed.

2. Homogeneity of mass, speed and direction of road users
Large differences in speed and mass of different road users in the same space must be eliminated as much as possible. Road users can best be forced to travel at lower speeds by road design. This works better than with signs. If crashes occur at lower speed differences they cause a lot less damage to the most vulnerable road user. Where speed differences cannot be eliminated types of traffic must be separated. On roads with higher speeds road users travelling in opposite directions should be separated by a division as well, to further eliminate conflicts. Cycle paths and pedestrians are always separated from these through roads, following the principle of homogeneity of mass as well as speed. Because of this principle the Dutch will never implement a combined bus/cycle lane as is common in some other countries. Instead there are bus lanes separated from other motorised traffic because the mass of cars and buses do not match either. Eliminating crossing movements is possible with roundabouts because on roundabouts traffic flows in less conflicting directions than on an ordinary traffic junction.

3. Predictability (of road course and road user behaviour by a recognisable road design)
Road design should be so consistent that road users instantly understand what they can expect and what is expected of them on a certain type of street or road. The road design itself gives information about the type of road/street. If the street is paved with bricks, there are parked cars and the street is shared with cyclists and gives access to homes, the road user will instantly know and feel this is a 30km/h (19mph) local access street. However, if the road has two carriageways separated by a median, there is no parking and cyclists have their own cycle paths, it is clear to the road user that this is a through road.

4.Forgivingness (of both the road and street environment and the road users)
Humans make errors and willingly or unwillingly break rules. This is a given that cannot be changed. So roads and streets should be designed in such a way that this natural human behaviour does not lead to crashes and injuries. An example is a shoulder with a semi-hard pavement. A road user coming off the main road will not crash immediately, the semi-hard shoulder will give this road user the ability to get back to the main carriageway. Forgivingness towards other road users is enhanced when road design leads to a predictable behaviour of road users. A result of this principle is that motorised traffic sometimes gives priority to cyclists even if they don’t have it. Because it is so clear where the cyclists want or need to go the motorist anticipates their behaviour and gives the cyclist more room than he or she is legally obliged to, often to the surprise of especially foreign cyclists.

5.State awareness (by the road user)
This principle is about the ability of road users to assess their own capabilities to perform tasks in traffic. This has to do with understanding vehicle operation and knowing how speed changes the behaviour of the vehicle to understand what speed is safe in a certain situation. But it also has to do with the assessment of speeds of other traffic users to estimate crossing times for instance. These abilities can be improved by education but there are limits, for instance when road users are children or elderly.

Results of Sustainable Safety
Many countries have seen a considerable drop in traffic injuries and deaths since roughly the 1970s. Reasons were the introduction of seatbelts, drunk-driving laws, helmet laws for motorcyclists and mopeds, car cages and airbags. But in the Netherlands there also was a dramatic drop in injuries and deaths of the most vulnerable road users: cyclists and pedestrians. Traffic researches attribute this difference to the introduction of Sustainable Safety.

Ten years after the introduction researches found a traffic death and injury reduction of on average 6% per year. And that wasn’t the only positive outcome. When the costs of the measurements that had to be taken were compared with the benefits of the reduced traffic injuries and deaths it was found that the benefits outweighed the costs by a factor of four.

Students of the Northeastern University in Boston compared the Netherlands with the US. After analysing all they had learned on their study tour in the Netherlands in 2010 they found the following: “In the 1970’s, the Netherlands and the US had the same traffic fatality rate (fatalities per person). Both countries have seen dramatic decreases in traffic fatality rates over the past forty years […]. However, the Netherlands has put much more emphasis than the US on making their roads inherently safer. The result: the Netherlands has reduced its traffic fatality rate to less than half of the US traffic fatality rate; the Netherlands now has a traffic fatality rate that's only 23% of its 1970 rate, compared to the US whose traffic fatality rate is 54% of its 1970 rate.

So the system of Sustainable Safety is undisputedly successful and separated cycle paths (albeit for specific roads and situations) are such an integral part of this system that they even need not be mentioned all the time.

Some people refer to "strict liability" as "presumed liability". There are also a few variations on exactly what people think it should mean. However, whether "presumed liability", "strict liability", "stricter liability" and however it's defined, the idea that changing just the legal position of cyclists will make any real difference to their safety is flawed.

This won't be the last post to appear on this blog because there are a few more already written and scheduled for future dates, however today's post is the last we're currently planning to write. The work-load has become too large, we're getting too many emails, too many requests. There are still many things to write about, but it simply consumes too much time to do this without a salary to support it. It's been a lot of work for both of us, and we're both due for a rest. Perfect driving will never happen (Campaign for Sustainable Safety, not Strict Liability - part 2)

Cycling campaigners often say things such as that there is "no such thing as an unavoidable accident". After crashes occur in which cyclists are injured or killed there is often an effort to lay the blame on the individual driver who was operating the motor vehicle at the time of a crash. Cyclists in English speaking countries often call for strict liability under a mistaken belief that this will improve conditions for cycling. Many people who call for this law mistakenly believe that the law's existence on its own somehow makes drivers behave better, but this is a misunderstanding. The law in the Netherlands exists merely to address issues of material damage and financial liability. It does not apportion blame and is mainly confined to reducing liability of children.

Bad driver behaviour is undoubtedly a problem for cyclists. Cyclists often find themselves on the wrong end of the result of bad driving and as a result it is quite common for cycling campaigners to urge drivers to take better responsibility for their actions. There are many ways in which drivers of motor vehicles put themselves and others in danger. For example, drivers should never be distracted by mobile phones or by talking to passengers. They should not look away from the windscreen in order to squint at a navigation system. They should slow down if visibility is bad. They shouldn't eat or drink while driving. They should always allow adequate space when passing another vehicle. They should never pass when going around a blind corner, should always slow-down when there is a risk of ice, demist their windows when they can't see properly, not hurry when they're late for work, never look past a pedestrian or cyclist and see only the car further away, never drive too close to the vehicle in front, never become tired and fall asleep. There is a long list of things that drivers should always do and should never do, but though every driver knows that this wrong behaviour is common.

It's true that road safety would be improved. Campaigners sometimes refer to this as "low hanging fruit" as they see improving driver behaviour as an easy thing to achieve. Danger faced daily on the roads would of course be reduced if only we could convince all drivers to behave better all the time. However, there is a limit to what can ultimately be achieved and it is my belief that we are already quite close to that limit. Diminishing returns for training effort set in long ago. In Western nations which already have relatively good records for road safety there can be only very slight improvements in safety if driving for large efforts in training and enforcement. No matter how often we call for drivers of motor vehicles never to crash those vehicles and always to behave in a perfect manner, they will still make errors of judgement.

Cyclists are often seen as a misunderstood and hated out-group. Some drivers make unpleasant comments about cyclists, sometimes are even deliberately aggressive. That cycling campaigners see "bad driving" as a crucial issue is understandable because cyclists come off worst in crashes between motor vehicles and driver error is a common cause of these crashes. Cycling campaigners often equate bad driving with deliberate acts however very few deaths of cyclists are actually due to deliberate violence by drivers. Overwhelmingly, deaths and injuries of cyclists are the result of mistakes made by either the driver or the cyclist.

Accidents happen. They will always happen. While many campaigners dislike the word "accident", it is actually correct to use this word other than in the very small number of cases where a deliberate act causes a crash. Humans are not perfect machines and will always make mistakes

Be kind to animals !
While some drivers express annoyance at cyclists taking space on "their roads", the same emotional outbursts are not common between drivers and animals. Animals are not a human "out-group" and the deaths of animals on the road are neutral with regard to interactions between human beings. I think we can learn something from these deaths.

The scale of roadkill statistics is surprising to many people - according to a roadkill study from 1993, an almost unbelievable six million dogs and 26 million cats are killed each year by motorists in the USA. Those are just the "domesticated" animals. Other mammals include 41 million squirrels, 22 million rats, 19 million opossums, 15 million raccoons, 350000 deer. The total number of animals killed on US roads is estimated at one million per day and there are about 200 million drivers in the USA. On average, each driver in the USA kills an animal every seven months. There is no reason to believe that the USA is any better or worse than other nations. The USA is my example for no reason other than the availability of figures for that nation.

While many people might not feel upset about the death of a rat, they don't drive over them in such numbers on purpose. Perhaps more interesting are the figures for the pet animals. Very few people would deliberately harm a dog or cat, yet over 70000 cats and over 16000 dogs are killed by American drivers every single day.

For reasons of self preservation alone it's a good idea not to run into a larger animal such as a deer yet just the state of Michigan reports that "there were 56,666 deer-vehicle collisions in that state in 1994, and each year deer-vehicle collisions in Michigan kill an average of five people and injure 1,500". Michigan's deer collision rate works out as more than 150 per day. Have they not erected signs to tell people where the greatest risk is ? Are drivers not advised to avoid running into deer ? Of course they are. Have these attempts at education worked ? Of course not. Driver education can never result in there being "no unavoidable accidents", people will always make mistakes. Accidents will always occur.

Human beings are fallible
Car crashes are the inevitable result of putting human beings behind the wheels of cars. Human beings simply don't have the ability to behave in a faultless manner so even the most careful people are sometimes involved in crashes. Normal people going about their everyday business with no intention to cause any harm at all are spreading carnage along the roads, not only of the USA (which I picked only because I found the numbers for that country), but also of all other countries.

None of this is new. In fact, it's as old as cars themselves and of course the victims of this violence on the streets are not only animals but also humans. Back in 1896 a coroner who investigated the world's first fatal car crash made his view quite clear by saying that "this must never happen again". Much effort has been expended on preventing it from happening. In the 117 years between then and now, driver education has improved enormously and there have been countless campaigns to encourage safer driving. You may ask what the result of this has been and the answer is that there are now 1.2 million deaths every year due to crashes by motor vehicles. Perhaps a small fraction of these might be deliberate acts of murder, but the vast majority are accidental.

The connection between animal and human deaths on the roads is a simple one to make. The vast majority of these deaths are caused by motorists who are not deliberately dangerous, but who overestimate their ability, misread the road or who are not paying sufficient attention to what they're doing. This is not so much a failing of individual drivers but simply a normal part of the human condition. People are always distracted. We evolved to deal with travelling mostly by walking, occasionally running for small distances, but we're not actually faultless even at walking pace. Who has never walked into a lamp-post, stubbed their toe or tripped up ? Why are we surprised that the task of controlling a motor vehicle at higher speeds safely for long periods of time is difficult for us ? We're not very good at this sort of task and we will always make mistakes. It's not just the occasional bad driver who makes these errors, but normal drivers who have been trained well, passed a test to show that they understand how to drive well, who have been exposed to education campaigns and who drive past warning signs every day on their journeys. These average and good drivers still crash with alarming regularity.

When we pick on an individual driver after a crash has occurred this is an application of 20:20 hindsight. Every driver on the roads makes mistakes. We can't predict which driver will make a mistake next and we can't predict which mistake will turn out to be fatal for a cyclist or pedestrian, or even for the driver him/herself. Punishing an individual for a crash which has already occurred does nothing to prevent the next crash.

How can we avoid making mistakes ?
We cannot address fundamental human failings by changing the law or proposing more punishment for failure while the underlying task that we are asking drivers to perform remains so difficult. Punishment does nothing to address the reason why mistakes are made, which is that we are human and can't cope with the task of driving. Even the threat of heavy punishment won't make people perfect.

The way to address the problem of putting human beings in charge of any dangerous activity is to limit how often they have the opportunity to make catastrophic errors. There is a precedent in aviation .

Historically, a large proportion of aircraft crashes were the result of pilot error. Pilots have crashed aircraft and often brought their own lives as well as those of others to an end due to such simple human failings as overconfidence and showing off. However commercial flying in particular is now very safe indeed. The improvement in the safety record for commercial flights has been achieved in large part by removing the opportunity for human beings to cut corners and make mistakes. This is the reason why pilots do such things as work through a check-list before they launch themselves and several hundred other people into the air. Check-lists might be boring but they result in a consistent check being made of important systems and any problems with them being spotted before they occur. When in the air, commercial aircraft benefit from several sets of eyes on the controls and from automated systems which sound an alarm and draw the pilot's attention if the aircraft is flying too low, too slow, falling quickly, too close to another aircraft etc. Automated navigation equipment has improved safety by removing human error so that aircraft don't run out of fuel in locations far from their destination. Automatic pilots take over much of the boring flying during which human pilots might lose concentration. Automated systems help landings to be made safely when visibility is not good. It is dangerous if aircraft fly too close to each other so they are kept apart. Small aircraft can be affected by the disturbed air left behind by larger aircraft so they are kept even further apart.

Aviation has been made safe by removing the opportunity for humans to make so many errors. The same principle can also be used on the roads.

In the Netherlands, the principle of sustainable safety is credited with improving the safety of the roads. It is the equivalent of the measures which have been taken in the air. Road designs are made self-explanatory. Everyone knows where they should be without having to read lots of signs. The task of driving or cycling is made safer by reducing the amount of thinking that drivers or cyclists have to do. While this reduces the frequency with which motor vehicles crash, it cannot completely remove human error from driving. Cyclists are kept away from where the inevitable out of control motor vehicles are likely to end up. The source of danger is kept away from those who are most vulnerable. This is how The Netherlands has achieved a better degree of overall road safety than almost all other nations, and a particularly enviable record of road safety for cyclists, pedestrians and children.

How this relates to Subjective Safety

It's fortunate that the same changes to the environment which remove danger from the roads are also in large part those which lead to a better degree of subjective safety. If roads and cycle-paths are subjectively safe then this makes cycling accessible to the public at large. It reduces the anxieties of parents about whether their children are safe to ride a bike. It reduces the anxieties of older people who ride here in increasing numbers and it results in everyone being able to cycle. Merely changing the law to punish errant drivers will not have this effect. It didn't have that effect here either - "strict liability" came some years after the construction of a comprehensive grid of safe cycle-routes which go everywhere.

Strict liability is positive for any country because it determines who has financial responsibility in the result of a crash. In The Netherlands we see no opposition to the law because everyone wants their children to be immune from financial responsibility if a crash occurs between their bicycle and a car.

However strict liability is really a side-show issue for any country where cyclists still do not already benefit from proper cycling infrastructure and where cycling is still a minority pursuit because of the lack of that infrastructure. It's a contentious issue which drives a wedge between cyclists and drivers. Drivers see this as an attempt to blame them for crashes which are not their fault and it is not surprising that they see this as unjust. Many of the people campaigning for the law don't understand what its true scope is and some of the campaigners actually really are asking for an injustice to be made law.

Today's drivers are potentially tomorrow's cyclists. It makes no sense at all for cyclists to put effort into alienating themselves from their potential allies, but this is precisely what is happening with the emphasis on blame which comes through strict liability campaigning. Though the potential benefit is very small indeed, this is still a difficult battle to win precisely because it appears to be unjust.

Strict liability is simply not a worthwhile thing to spend time in campaigning on in countries which face far larger problems. To campaign on this issue consumes considerable campaigning effort for something which can never result in the masses cycling because it doesn't even start to address the main issue standing in the way of people riding bikes. The Netherlands achieved success by transforming the environment to be safe for all road users.

If you want to copy the Dutch success in cycling then you need to campaign for all those things which really made and continue to make a difference in the Netherlands, not just anything described as "Dutch".

Segregation of modes is the big thing which enables mass cycling. Just like humans, animals benefit most in safety terms from being segregated from motor vehicles. Wildlife bridges are important because for some endangered species being hit by motor vehicles is one of the most significant causes of death.
What this post is not about Various comments have been made about this post, for example: "David Hembrow says accidents will happen, and there's no point in holding bad drivers accountable". This is, of course, not actually what I said at all and the thread which carried on afterwards went into even wilder diversions from the subject of this post.

There are a small number of genuinely bad drivers. These drivers break many laws and take many more risks than average and of course they feel the force of the law. Ideally they should not be allowed to continue to drive. Some people have even used motor vehicles deliberately as weapons. In these cases an existing law has been broken. Assault with a motor vehicle as a weapon should be treated just as seriously as assault with any other weapon. There may be examples in some countries where where there have been problems with achieving prosecution when a car was used as a weapon and this may well be something worth campaigning about. However, none of this is what I wrote about above because criminals cause but a small minority of the total number of crashes which occur on the roads.

Most drivers are neither particularly good nor particularly bad. When talking about "good drivers" and "bad drivers" we are often actually talking about the result of a perfectly average drivers in an average states of concentration who find themselves in different circumstances from one another. Most average drivers never cause the death or injury of another human when driving. However, most of those who have caused death or injury were no less skilled than those who have not. This comes down in large part to nothing more than luck. An average driver in the wrong place at the wrong time may cause a death. An equally skilled driver who never had the same bad luck might drive for his/her entire life without ever having even a minor bump. That someone could end their life with a perfect driving record does not necessarily indicate that they were a better than average driver; it is more likely that it shows they had better than average luck and found themselves with fewer dangerous situations to deal with.

Handing down particularly harsh punishment on a driver who was involved in a lethal crash after it has already occurred will do nothing to prevent similar bad luck leading to a similarly skilled driver being involved in a similar crash in similar circumstances at some time in the future. Indeed, if the road remains in the same state as when the first crash occurred then this is almost a certainty that the same thing will happen again in the same place if given enough time.

If we wish to address the problem of average drivers' mistakes causing injury and death, punishment is an almost useless response. Even if every drive who has already killed is locked up in prison this won't do anything to stop other average drivers faced with the same difficulties from making the same mistakes. However, changing the road design to make mistakes less lethal will work for all drivers. This is the gist of Sustainable Safety. If you remove conflict from roads and, especially important for cyclists, remove vulnerable people from the path of those in motor vehicles, then safety on the roads is improved.

The safety of roads in different countries is in very large part a function of their design and far less a function of the behaviour of different country's drivers. We're all from the same gene pool and all populations have a similar range of abilities. We all have the same human failings. The difference between the countries on the left and the countries further to the right come down in large part to the standards of road design.

This chart shows overall road safety and does not highlight the safety of cyclists. While almost all oher countries would gain increased safety for their drivers if they adopted infrastructure such as is in the Netherlands, for cyclists the safest place by far is The Netherlands (read footnote at that link). Cyclists elsewhere especially stand to gain from campaigning for the type of infrastructure which is common in the Netherlands, but it's worth bearing in mind that adopting this infrastructure will also benefit all other road users. The benefits of Dutch infrastructure also include keeping drivers from harming themselves and each other quite so often.

On-Road Cycle-lanes are dangerous. Oostrum's children deserve better

At nine in the morning on the 27th of November, a sixteen year old girl in the village of Oostrum (in the province of Limburg, in the south of the Netherlands) was seriously wounded when she was involved in a crash with a car. Sadly, this was not a unique event. While the Netherlands is the safest country in the world in which to be a cyclist, it is still the case that hundreds of people are injured and killed every year in this country. The Netherlands could still do better.

In the case of this unfortunate incident, some residents have been calling for changes in order to improve the safety of their children. When the Dutch TV programme HvNL (Heart of the Netherlands) reported on the incident they included comments from a local politician who wants change as well from a local councillor who saw no problem. During the short time that they were on site, the film crew caught a collision which could have resulted in a serious injury:

Why is this road dangerous ?
There is a common thread running through many stories about traffic accidents in the Netherlands. Where injuries occur, it is often the case that they take place where the infrastructure is sub-standard. This location definitely has substandard infrastructure.

It's easy to see where the opportunity for the crash came from. This road carries a lot of relatively high speed motorized through traffic as well as a lot of cyclists. Many of the cyclists are children going to school and they have to make a difficult to judge manoeuvre, crossing parallel traffic while checking both behind and in front, as part of their daily journey.

On-road cycle-lanes
Cycle-lanes are not really infrastructure at all, they're just paint. This road is decorated by particularly narrow on-road painted cycle-lanes and does not have the physical infrastructure which could protect cyclists from the danger of motor vehicles.

Wide cycle-lanes (wider than 2 m) can be useful in some locations as they can then help to encourage drivers to pass at a safe distance. However, even wide on-road cycle-lanes are not suitable for roads where there are many motor vehicles or where either the motor or cycle traffic doesn't fit in the allocated lane.

Narrow cycle-lanes like the one involved in the incident in Oostrum don't work very well anywhere. These encourage cyclists to ride in the gutter and they encourage drivers to expect cyclists to be in the gutter. Cycle-lanes of this design encourage close passing and risk-taking by drivers. They're often associated with drivers overtaking cyclists and almost immediately turning across their path. All cycle-lanes, regardless of width, make it difficult for a cyclist to safely turn across other traffic. Junctions need more thought than is apparent on this road.

to overtake. What's more, these cycle-lanes even encourage
cyclists to ride in "the door zone" next to cars in parking bays
 at the same time as encouraging drivers to overtake those
cyclists within a pinch point. This is poor infrastructure which
causes many conflicts. At least cyclists don't have to deal
with drivers turning right at the junction. Just because you
can find an example of something like this in NL
that doesn't mean it is good and should be copied.
More about Oostrum
In a location where many children cycle to school this lack of well designed infrastructure encourages dangerous behaviour by those children and puts them in danger. But it's not only at this point - the road looks much the same for a stretch of about 1.5 km, well into the next town, Venray, and for most of the distance, including where the collision took place, the speed limit is relatively high at 50 km/h

The local councillor interviewed by the TV crew doesn't see the problem. He gave a response on camera in which he said that there were good sight lines and everyone should be able to see what everyone else is doing and behave accordingly. British readers may find parallels with Boris Johnson's widely criticised comment that cycling in London is "OK if you keep your wits about you".

What about training and "Strict liability" ?
Unfortunately, the councillor has slipped into a common mode of thinking amongst people from all countries. It is imagined that given enough advice, people won't make mistakes. This is a fallacy. People will always make mistakes. This almost defines us as being human. Not only will no amount of training prevent either child cyclists or adult drivers from making mistakes, but law changes or punishment for mistakes will also not remove the possibility of mistakes occurring.

Readers from overseas who sometimes over-estimate the effects of "strict liability laws" in the Netherlands should note that this law doesn't prevent mistakes from being made in locations like this where the infrastructure is inadequate to the task of keeping people safe. The Dutch drive no more perfectly than do people of other nations, and while Dutch children receive limited traffic training in school, it's quite obvious from watching groups of children cycle that this doesn't have anything like the beneficial effect on behaviour that training advocates imagine.

Just because someone is Dutch and lived through campaigning forty years ago about childhood freedom and safety, that does not mean they will automatically understand about these issues. Some people simply can't see things from the point of view of others. Cycling is almost too common in the Netherlands. People take it for granted and don't realise that the high cycling modal share of this country is due to infrastructure and not culture.

Sustainable safety prevents injuries
What makes Dutch roads and cycle-paths safe is not training or strict liability but Sustainable Safety (Duurzaam Veilig). Sustainable Safety is a policy of reducing the opportunity for mistakes to become injuries by reducing the consequences of making such mistakes. Roads should be self-explanatory and forgiving (read an article which explains more).

The passing of time
Stationsweg is the road to Venray's railway station, so has probably always been quite busy. However, it hasn't always been like this. At some point, probably in the 1980s, adding cycle-lanes to this road perhaps seemed to make sense. However, the world didn't stop then. Both Oostrum and Venray have experienced growth in the last thirty years. There are many new homes, many more people. Car ownership in the Netherlands has grown and the use of cars has also grown with it.

Not all infrastructure in this country has been updated to current standards. Stationsweg in Oostrum is just one of many examples of roads which lag a long way behind the standards of 2013. The principles of Sustainable Safety have yet to make a dent here. There's some catching up to do.

Change is needed
Residents of Oostrum are absolutely right to demand changes which will improve the safety of themselves and their children. The safety of the next generation is the best thing any of us we can possibly campaign for.

In my view there are several obvious ways in which safety could be improved at the point of the accident:
  • Diverting motorized traffic using this road to other routes would remove much of the danger from cars, regardless of other measures.
  • Lower speed limits would make it easier to judge the speeds of cars and reduce the severity of injury.
  • A raised table and narrowing of the motor lane to a single vehicle width could reduce the speed of cars at the point of crossing.
  • 90 degree crossing would make it easier for cyclists to see cars coming from both directions.
  • central reservation for crossing would remove the need for cyclists to see in both directions at once.
  • A parallel cycle-path along much of the road would provide more distance between motorized vehicles and cyclists.

Have the Dutch forgotten what was achieved ?
in the 1970s, the Stop de Kindermoord (Stop Child Murder) protests gained mass support. Other local actions such as dramatic protests in De Pijp in Amsterdam also played a part in changing the way people thought about safety on the streets. This country began to transform itself 40 years ago. and that happened because there was popular support for change. While not everyone was in agreement at all times, the entire population was behind the idea of children being safe and infrastructure across the country was transformed as a result.

Unfortunately, keeping up momentum is not easy. Because such a long time has passed, people have forgotten how important this was. The safety of children is no longer an explosive campaigning issue. The situation in the Netherlands isn't bad overall. Dutch children are still rated by UNICEF as having the best well-being in the world, but this is a sign of past success and did not come about due to current policy. The adults who led the change in the 1970s and the experts who designed the improved infrastructure have largely retired. There are signs that their good ideas are to some extent being forgotten. The children of the early 1970s, for whom the actions were taken, are now middle aged and even their own children are grown up. Younger activists are largely unaware and unappreciative of what was achieved and how unique and significant this was. Even Dutch people often fall into the easy trap of believing that they cycle because it's in their culture. We've found that people are quite shocked if shown pictures of what their streets used to look like because they don't remember the problems that designing towns solely around motor vehicles used to cause.

This is a dangerous time for the Netherlands because some of what made this country great is being forgotten. It should be no surprise that Dutch children are being taken to school by car more often these days.

Why take a study tour ?

When we first started visiting this country (in the last century), there was no-one to guide us and we formed impressions based solely on what we saw. Like other people who have done the same, we came to some incorrect conclusions.

Compared with villages in other countries, it's possible to approach Oostrum on surprisingly good quality cycle-paths. The village largely has relatively low speed limits and contains both a raised table in the centre and on-road cycle-lanes leading to the west. Not all of this is bad, and of course it could appear to be an example of relatively good practice. It would be easy to overlook the problems cause by the use of on-road cycle lanes on a busy road, especially if these were not witnessed first hand because of the time of day when they were observed.

We find it is not at all uncommon that people take photos of substandard infrastructure that they've found in the Netherlands and try to have similar ideas adopted after they return to their own country. Not only does older infrastructure not necessarily make itself obvious if you're from a country which is less advanced with regard to cycling but people also sometimes view what looks more familiar as more achievable, even though the cost difference is often not large, and doing something twice in order to fix a mistake is always more expensive than doing it properly in the first place.

We initially started running study tours because no-one else at all was offering this service. There is much that other nations need to learn from the Netherlands but this knowledge was either not being transferred or it was being misunderstood (e.g. enthusiasm about what the Dutch got wrong. e.g. Shared Space). As a result of our relatively early start, having moved here, learnt Dutch and as a result of having shown hundreds of people both what is good about cycling in the Netherlands and the pitfalls that must be avoided, we now have more experience than anyone else. Being completely independent of any other company we have no reason to push ideas in order to sell them. We simply show you what works and what does not.

If Oostrum were local to us, we might visit to point out problems to be avoided. However there's no need to make a special trip. There are bad examples of infrastructure closer to home which already feature on our study tours, where we explain the problems caused. We also, of course, feature examples of very good infrastructure and encourage people to learn from these about what really works to encourage cycling. Our tours allow you to save yourself from misunderstandings and wasted effort.

The Netherlands has the difficult job of being in front and not having any other country to copy from. In other countries the job is much easier and there's no time to waste. You're already decades behind what the Dutch have achieved and the Netherlands still stands as very easily the best example to try to emulate.

Note that in most cases, Dutch children make relatively uneventful journeys to school. This is what makes cycling to school so popular in the Netherlands. However we have to be wary because there has been a small decline in recent years.

The Netherlands sets the best example, but don't copy anything just because it is "Dutch"

While Germany is a genuine leader in renewable energy, and Danish design is known across the world, it is the Netherlands that should be looked to as the leader in cycling.

infrastructure is a moving target.
Observers from other countries with a far lower level of cycling often express an interest in Denmark or Germany because they are considered to offer a more "achievable" or "realistic" target to aim for. A cheaper solution is sometimes seen as an easier thing to emulate than the Dutch solution. It's true that those nations spend less, however they also achieve less. While the Netherlands continues to grow cycling from an already higher base (in 2011 the population cycled nearly 10% more than in 2010), Denmark is struggling against a long term decline in cycling and Germany has infrastructure which is unpopular with many of its cyclists. Are those good scenarios to aspire to ?

Let's not even consider the absurdity of looking towards places which have achieved even less than Denmark and Germany, be they vocal cities in the UK or USA or elsewhere. What works for a minority cycling modal share and what works in a limited area with a demographic bubble are not necessarily what works for true majority cycling over an entire nation.

It makes no sense to campaign for something which isn't actually good enough. Campaigners should be inspired by the best of Dutch infrastructure and be wary of distraction by things which don't have a proven record of success.

Don't blindly trust the CROW manual

The CROW Design Manual for Bicycle Traffic manual is as good a manual for cycling infrastructure design as exists. However it's not perfect. The manual tells you how to do a great many things, but it does say so much about which solutions are good solutions. For example, it rather glosses over the serious safety problems caused by "mixing lanes", and the section on them doesn't suggest much better solutions for similar junctions. The CROW manual can be used to justify many things which you would not expect a modern Dutch road layout to include.

Unfortunately there sometimes seems to be a lack of "quality control" when people are inspired by what they see in other places, including what they see in the Netherlands. Not everything "Dutch" is equally good and equally worth emulating. Sometimes there are apparent "solutions" which seem easier to copy and these get too much attention. This isn't helped by the Dutch themselves occasionally forgetting about why they cycle and placing far too much emphasis on things which are less important or by their giving a lot of press to new ideas which are unproven or which in some cases simply don't work.

What's Dutch and should be ignored ?

Traffic lights which give cyclists priority when it rains have been in the news recently. This sounds lovely of course until you give it a little more thought. The article states that "The rain sensor did not lead to significantly longer waiting times for the non-cycling travellers, nor did it produce jams or stagnation". Now if the change in cycle timing benefits cyclists but does not cause a problem for other road users, then why do we not have that new timing all the time instead of only when it rains ? It's illogical in the extreme to do this, and as it costs an extra €10000 per traffic light, why bother when the same benefit can be found by reprogramming the lights permanently ? This is a gimmick which sounds good in a press-release but is otherwise quite silly.

Another recent idea was heated cycle-paths. Again this initially sounds like a fine idea, until you realise that it is simply not practical. This idea is estimated to cost between €20K and €40K per km. However, the Netherlands has 35000 km of cycle-paths so it would cost a thousand billion euros to implement everywhere. Clearly this cannot ever happen. At best a very small percentage may be heated, perhaps outside the town hall, and the traditional way of clearing paths (which is already very successful) will have to continue anyway. What's more, the increased cost of maintenance and the energy required to warm the paths has not been accounted for. This is another gimmick which sounds good in a press-release but doesn't really translate into much on the ground.

A third example in recent months is the idea of roads which glow in the dark. This "designer" nonsense even won "Best Future Concept at the Dutch Design Awards". The resulting press-release was taken up by organisations around the world and it received a considerable amount of coverage. Did no-one think about how impractical this is ? It's really a daft idea. Dutch roads genuinely do have a problem with how visible they are after dark, but spreading a thin layer of rapidly worn away paint across the entire surface is not the way to deal with this. British roads have provided an example of a better solution for nearly 80 years ! Cat's Eyes are retroreflective devices found in vast numbers along Britain's roads and motorways. The very clever design of Cat's Eyes means that they retract to avoid damage so are resistant to being driven over by trucks and even snow-ploughs, and that they use this retraction to clean themselves. What's more, they've a proven history of success. Having driven on both Dutch and British roads and motorways after dark, I can state that it is quite unequivocally easier to do so in the UK because you can see so much better where you're going if the centre-line and sides of the road are fitted with Cats Eyes.

 time to ask for big bridges and tunnels
Often there is an over-emphasis on the most recently built exceptional pieces of infrastructure. To claim in a press-release that you will build the "longest", "tallest", "widest" or whatever of anything is of course a real crowd-pleaser. It guarantees free publicity even before the new thing exists. Cities which have built exceptional pieces of infrastructure often use them to hype themselves.

I have received email from Dutch architects and "creative engineers" asking for me to advertise for them by writing posts about their latest projects on this blog and I've been invited to events and other such things. However I am not interested in astro-turfing for such companies and you should be wary of reading articles which are the result of marketing campaigns. Until something has been finished, proven to work and has a long record of being cost-effective, it's not ready to be copied elsewhere.

Campaigners need to be wary of all of this. Publicity is not our aim. Cycling is our aim. Exceptional pieces of infrastructure can only ever make up a small percentage of the total and if given too much emphasis they distract attention from the important point that it is the very high standard of the infrastructure which goes everywhere and which everyone uses every-day for all their journeys which creates a high level of subjective safety and attracts people to cycling. Fancy bridges, tunnels or claims for the "longest" cycle-paths or whatever are nice to see and occasionally convenient to use, but they're icing on the cake, not the cake itself. I've occasionally covered exceptional pieces of infrastructure on this blog, but with warnings.

There is also the perennial favourite of "Shared Space" road layouts. Despite having failed as a concept here in the Netherlands, there being no new large "Shared Space" projects, these ideas keep being pushed with enthusiasm elsewhere, quite often by those who stand to gain from contracts for its implementation. Even here in the Netherlands they sometimes achieve design wins, even though we know that shared space is not really safe. These days, with an increase in interest in Dutch cycling infrastructure elsewhere, "Shared Space" is sometimes pushed on the grounds that it's "Dutch" and therefore must be good. However, in practice this is now barely a Dutch idea at all. While a Dutch invention and while such layouts had brief popularity here in the early 2000s, the problems with this "emperor's new clothes" manner of redesigning streets are now quite clear and few people would ask for this. Far fewer than 1% of the street layouts in the Netherlands are "Shared Space" and as a result they form just a few weak links in an otherwise very good network of infrastructure for cycling. The real way of civilizing city centre streets is to remove most of the cars from them. Compare a video of a street which was once shared space but is more pleasant now that motor vehicles have been removed with another showing how shared space is both dangerous and inconvenient for the vulnerable.

Turbo Roundabouts are a Dutch innovation to keep motor vehicles moving. They're horrible for cyclists, causing danger and inconvenience and cyclists are never expected to use the road on a turbo-roundaout. Protests about infrastructure are rare in the Netherlands, but there have been protests against Turbo Roundabouts because even crossings at such roundabouts are not necessarily safe.

While Turbo Roundabouts are bad news for cyclists, let's also look closely at the other roundabouts often promoted by advocates of Dutch cycling infrastructure.
Over the last two decades many studies have investigated the safety of different roundabout designs (the link takes you to several of my articles about these studies with the results translated into English). Some of these large scale studies used data from hundreds of "roundabout years" to build up a comprehensive picture of which designs work best, and which cause injuries to Dutch cyclists. As a result of their use of such comprehensive data the results are not easy to dismiss, but unfortunately there's a lot of reading to do to understand them and as a result they have mostly been ignored in the Netherlands. Due to this, most Dutch experts still promote a roundabout design which unnecessarily hospitalizes hundreds of Dutch cyclists each year as being the best, and even "safest" practice. The dangerous design is even being promoted for adoption in other countries where motorists take less care around cyclists than is the case in the Netherlands. We also have roundabout designs which are exceptionally safe for cyclists but these are rarely promoted as examples.

Please choose the safe roundabout design and when copying from it take care to copy the entire thing. I've seen several examples of engineers from other countries trying to pick some aspects of Dutch roundabout design but missing out others of greater importance, resulting in less than safe or convenient results. It's common for people to focus on the geometry. i.e. they see the difference in exit radii and the size of the island in the centre but miss out the cycle-paths. So far as cyclists are concerned, the cycle-paths are the fundamental reason why Dutch roundabout design works well. Miss them out and you do not have a "Dutch" roundabout.

While on the subject of large junctions, traffic light junctions in the Netherlands are not all created equal either. The best design of traffic light junction for cyclists is the simultaneous green design. This is not only extremely convenient but also has proven to be extremely safe and it fits almost any size of junction. Anything else compromises at least one of safety or convenience. Unfortunately, much discussion elsewhere is concentrated on the "Standard Dutch Junction" or the "Protected Intersection", both of which are versions of older and less successful designs.

What's Dutch and often misunderstood ?

Lower speed limits are a good thing. The Dutch think so - and that's why more than a third of the total road network in the Netherlands has a 30 km/h or lower speed limit. However, research published in the Netherlands four years ago showed that merely lowering the speed limit was not nearly enough of an intervention to make roads safe.

Residential areas and villages should have speeds no higher than 30 km/h / 20 mph on their streets. However, even where there is such a low speed limit it is often necessary still to have separate cycling infrastructure, and low speed limits certainly don't remove the need for separate cycling infrastructure in other places.

Achieving safety requires removing cars or building separate infrastructure for bikes and of course junction design is important too.

It is worthwhile to campaign for lower default speed limits but lower speed limits should be viewed as just one of a number of tools to civilize the streets and their contribution should not be over-emphasized. The same goes for Strict Liability, the importance of which is often much over-stated in other countries and which is often misrepresented as meaning that drivers are taken to be responsible for all crashes which occur between bikes and cars. In fact, strict liability was introduced after the Netherlands already had an extensive cycling network and it is this network which makes cycling popular, pleasant and safe. Separating cyclists from motor vehicles as much as possible, building a dense network of cycling routes and making cycling routes shorter and more convenient than driving routes are all more important than either lower speed limits or strict liability. Separating bikes from cars has a much greater effect on subjective and actual safety than does changing the laws which apply to drivers.

Unravelling of routes so that cyclists do not have to travel parallel with motorists can make it possible to segregate modes without specific cycling infrastructure. However, the resultant routes for cyclists should be the direct routes, not indirect routes which go "around the houses" in order that cyclists are merely kept out of the way of motorists.

In the Netherlands it is quite normal that drivers find themselves having to take a detour in order that residential areas can be pleasant places to live. Cycling routes can pass through residential areas, but...

Woonerven (or "living streets" - similarly, the living-room in a Dutch house is called a woonkamer) are residential streets in which people take precedence over motor vehicles. The concept was especially popular in the Netherlands in the 1970s and 1980s.

While woonerven provide for access by any means of transport, they should not be through routes by motor vehicle. What's more, they should also not be through routes by bicycle. Woonerven are not cycling facilities, they are intended to be pleasant places to live. This is not enhanced by having nose to tail commuters heading through these streets either in cars or on bikes.

If someone suggests that a woonerf should be a through route for bicycles, look out. Not only have they fundamentally misunderstood the concept of a woonerf, but they're probably proposing to send cyclists "around the houses" rather than provide the direct routes that cyclists need.

From many peoples' interpretations of what the Dutch have done, you could come to the conclusion that many things are "anti-car" in this country, but it's not true. The Netherlands is a rich western nation in which people can easily afford to own cars if they want to, and this country does not make it difficult to own, drive or park the cars that people own.

New-build residential areas provide ample car parking so that ownership of cars doesn't cause problems for other residents. Many shops offer free parking. The city that we live in, Assen, has the cheapest car parking in the Netherlands. What's more, the roads are well maintained and well sign-posted. They're a pleasure to drive on.

That driving can be very convenient for some purposes, and that people like to own cars does not stop those same people from cycling if cycling is an attractive option. But for this effect to become reality, cycling must be a very attractive option people for people from all walks of life. There is nothing unique about the Dutch people which makes them ride bikes - they find it useful to do so because it has been made into an easy choice to make and that comes because the environment encourages cycling. The Dutch have successfully harnessed the enormous pent up enthusiasm for cycling that exists everywhere. The desirability of cycling results in people using their bikes even though commutes by car are subsidized by the Dutch government.

The first pedestrianized street in the world was built in Rotterdam in the Netherlands and there are now many pedestrianized zones across the country. However, unlike pedestrianized zones elsewhere which ban cycling these are usually easy to access by bicycle. However, note that these are generally not main bicycle routes. A main route through a shopping street could cause conflict. Similarly, shared use pedestrian/bicycle paths are not built because they also cause conflict. For the same reason, bus lanes are not combined with bicycle lanes.

Be wary of "holiday opinions". Holidays in other countries are not remotely like living there for a period of years and they often lead to people having a view of their holiday destination which doesn't fit reality. To understand another country you have to live there for years and put some effort into understanding how things are in your new home.

Note that Dutch commentators speaking about the Netherlands are equally unlikely to understand differences between their country and others unless they have lived for many years in other countries and spent the time to study those differences while they were there. The significance of the everyday and mundane things which are taken for granted by cyclists in the Netherlands can easily be forgotten. Dutch commentators are as likely as those from elsewhere to place an over-emphasis on the new and spectacular, particularly if this shows their country in a positive light. Also note that most Dutch people have no real understanding of the problems facing cyclists in other countries because they have not experienced them. After he read comments about "dooring" in youtube comments, I had to explain carefully to one Dutch bicycle blogger what this meant because despite cycling since he was a child he had never experienced it himself. There can also be problems with language, and that's not just restricted to bloggers. Even the Fietsberaad sometimes publishes documents in English which don't mean the same as their Dutch equivalents.

Dutch people have told me that the Netherlands suffers from all sorts of problems, such as particularly high unemployment, a high violent crime rate, a terrible problem with litter, mass obesity, particularly terrible economic problems. They also often think that mopeds are a huge problem for cyclists, though they're actually a non-issue in most circumstances. If you're close to even a small problem it can seem like a big problem. I've also been told that cycling is far more pleasant in the UK because of a supposedly more extensive British network of traffic free paths, which of course doesn't actually exist. The hyped initial promises for London's "superhighways" resulted in some Dutch media sources suggesting that the Netherlands could soon fall behind, which of course didn't happen. Why do people believe these things ? Without the perspective of seeing how other people live by living as they live it's difficult to be objective.

Cycle-chic style pictures and videos of peak time cycling (I made them myself way back in the days before youtube had HD) look nice but do not really teach us anything. When emphasis is on the young and pretty then the impression is given that they are the cycling demographic we should aim for. When wider demographics are featured they tell you nothing about why it is that older or younger people cycle or about how often they are seen doing so. Videos of masses of people cycling are of no real use without an explanation of why. The result is often to simply reinforce the irrational beliefs about Dutch cycling that many people already hold, and this can be read in the comments.

Not all things proposed as "Dutch" in other countries are actually Dutch at all. Two stage turns are an example of an inferior junction design of a type no longer built in the Netherlands, linked with fatalities in Copenhagen, yet copied as a "good" example of "Dutch" design in the UK.

These were built up to about 30 years ago in the Netherlands, but I've not seen one of these for more than ten years. A reader sent the location of the junction in the photo on the right. There's a reason why these went out of fashion - it's because they're unsafe and inconvenient.

While junctions like this might have been "Dutch" in the past, it seems a bit unfair to still blame the Dutch for them now when almost all have been replaced.

Solar panels are a wonderful technology. They are a reliable source of clean energy which should be adopted more widely. I believe in solar energy enough that I put my money where why mouth is and installed solar panels on our own home. However note what this "belief" is based upon. I didn't do this just because of a fanciful idea that this was "green" but only after I had done all the maths and worked out that panels in this location would generate enough electricity that they would definitely pay back both economically and environmentally.

In the UK we lived in a house where the roof faced the wrong way. I did the maths then and worked out that we couldn't expect a reliably positive return from solar panels on our roof because it faced in the wrong way. As a result, when we went house hunting for our current home we looked only at houses with south facing roofs specifically so that we could install solar panels and have them pay their install cost back. Bad locations make no sense at all with solar panels. Due to the cost (both environmental and monetary) of the panels, it makes absolutely no sense at all to install them in locations where they cannot work. Doing so is not in any way good for the environment, but actually negative because the environmental cost of producing and installing the panels will never be earned back during the life-span of the panels.

A cycle-path with solar panels in it has recently been opened in Krommenie near Amsterdam. This has been receiving a lot of press due to a vast campaign of hype. This is a completely ludicrous idea. Solar panels are a marginal technology. They are only economically and environmentally viable when mounted facing the sun, in a place where there is no shade at all and where they won't be damaged so will have a long life allowing them to continue operating for their payback period. South facing (Northern Hemisphere) roofs are an excellent place for solar panels. A location underneath a road, with extra levels of glass above, not sloped to face the sun, with shade from trees, cyclists, leaves, grime etc. and at risk of damage from weather effects as well as snow-ploughs and other vehicles is anything other than an ideal location. Dust is a problem even for solar panels on a roof.

It is impossible for solar panels placed under a road to ever pay back their cost of installation. The total environmental cost of building this "solaroad" will be higher than simply using asphalt on the cycle-path. It will certainly be higher than using asphalt on the cycle-path and placing the same solar panels in a more useful location.

Please try to ignore the hype. I'm sure the company who is pushing this idea will try very hard to sell it, but they are trading on people not being able to do the figures themselves and work out why this is a bad idea. The Dutch minister who opened the cycle-path is clearly confused. He has said that his "dream for the far future" is to be able to ride in cars driven by the power provided by the solar panels embedded in the roads along which they are driven. But he clearly does not understand the issues as his dream makes absolutely no sense at all. With any given solar panel technology you can always generate more electricity at a lower cost by putting the panels next to the road than by putting them under it and you're unlikely ever to get a positive return from panels in roads.

Note that no theoretical new technology can help this to make sense. There are limits to the efficiency of solar cells which current technology already approaches. Maximum output from any cell design is related to how much light hits the panels and starting by reducing the amount of light which hits the cells by burying them under a road is simply a ludicrous thing to do. These things could only be made to compete with solar panels placed in more sensible places by making the sun shine brighter, and even if that were possible it would still make more sense to put the panels next to the cycle-path rather than under it.

Three years later, a video (now deleted) appeared on youtube demonstrating how that first solar cycle-path was already falling apart due to weather effects and wear. It also demonstrated that the output was incredibly low for the large number of panels used and the high cost. My predictions came true, as did those of other sensible people who saw from the outset that the best place to install solar panels is never, under any circumstances, under a road.

What's the harm in doing something else ? What's the harm with making a slow start ?
The problem with following the wrong path is that time is wasted while this happens. The suggestion that campaigners should work towards something other than what the Dutch have has been made since at least the 1970s. Surely forty years of trying things that don't actually work for furthering cycling is enough. It's time to stop falling behind and catch up as quickly as possible.

The Netherlands is ahead in cycling mainly because other countries have never really been in the race. It's much easier to make an excuse about the Dutch being 20 / 30 / 40 / 50 years ahead and therefore difficult to catch up with than it is to make genuine political and financial commitments which will last for decades, but that is what is required in order to make a proper start at catching up. No more broken promises.

Conclusion: Use good examples to make progress
Not all of the best ideas in all fields come from the Netherlands. Not all Dutch ideas are good. Not all Dutch people know why they cycle. Not all Dutch people how lucky they are to be able to cycle as they do, and of course not all the infrastructure in the Netherlands is perfect, nor was it all built recently to current standards and nor was everything built recently built to good standards. In short, the Netherlands is far from perfect.

However, if you're interested in improving cycling in your own country this is still the most successful nation by a considerable margin and therefore is also the single best place to look for inspiration. The problem is finding the genuinely good examples from which to be inspired rather than picking examples at random. Never aim low because by doing so you guarantee not to achieve a high cycling modal share, but how can you be sure that you're aiming for the best ?

Campaigners with low aspirations for their own countries often seem to cling to inferior infrastructure in the Netherlands because they view it as "more achievable". However you have to see this in context. Examples of low quality infrastructure in the Netherlands are merely weaker points in a comprehensive network which is of high overall quality. The remaining examples of lesser infrastructure have typically survived where they are because in these locations they cause relatively few problems. However, infrastructure is constantly being upgraded (and occasionally downgraded) all across the country. This inferior infrastructure is under threat even where it works. If you refer to such infrastructure to form your standards, you run the risk of setting the standard for your best infrastructure to be equivalent to what has already been removed in the Netherlands. What was shown not to work well enough here will then be installed in places where it won't work well in your own country and having set a low standard you will be doomed always to achieve a lower cycling modal share than the Netherlands until the standard can be changed once again. If it's already taken forty years to set a standard, you need to get it right.

There is no need to learn from the past mistakes of the Netherlands by repeating them. You can leapfrog over them and copy what really works. Do make use of the best examples. Make sure you ignore the less good examples.

The worst thing for campaigners to do is to hamper their own efforts by not setting a high enough standard for themselves and for the community that they live in. If you were planning a mission to the moon, would you go to NASA for advice, or would you prefer to take notice of what the Ugandan space programme had achieved on the grounds that it looks more affordable than NASA ?
